On August 30, 2019, Frankie V’s Kitchen, LLC (the “Debtor”) filed a Plan of Liquidation and Disclosure Statement in Support thereof in the Bankruptcy Court for the Northern District of Texas, Dallas Division. On September 13, 2019, the Debtor filed its First Amended Plan (the “Plan," click HERE to view) and First Amended Disclosure Statement (the “Disclosure Statement,” click HERE to view).
On September 19, 2019, the Bankruptcy Court approved the Disclosure Statement for dissemination to creditors and parties-in-interest and entered an order (the “Disclosure Statement Order,” click HERE to view) approving certain procedures for soliciting and counting votes in connection with the Plan, setting a hearing to confirm the Plan, and granting related relief.
If you are entitled to vote, you should have received a Court-approved ballot for casting your vote and deciding whether to opt out of the releases proposed in the Plan (the “Ballot,” click HERE to view) as well as a notice indicating the time and date of the confirmation hearing (the “Confirmation Hearing Notice”). You should be aware of the following deadlines and/or hearing dates set by the Court in connection with the Plan:
Voting Deadline: Any party that is entitled to vote on the Plan will receive a ballot with this notice, and in order to be counted as a vote to accept or reject the Plan, that ballot must be completed and returned by Debtor’s counsel at the address below on or before October 21, 2019, at 5:00 PM (CST) (the “Voting Deadline”). For a Ballot to be counted, it must be received by counsel to the Debtor prior to the Voting Deadline at the following address:

Confirmation Objection Deadline: Any objection to Confirmation must be in writing and set forth (i) the name and address of the objector, (ii) the nature and amount of any claim or equity interest held or asserted against the Debtor’s estate or property, and (iii) all factual and legal bases for the objection and the grounds therefore. Objections must be filed with the Court or served in a manner such that they are actually received on or before October 21, 2019, at 5:00 PM (CST) by Debtor’s counsel listed above.
Confirmation Hearing: A hearing to determine whether the proposed Plan should be confirmed has been set for October 28, 2019 at 1:30 PM (CDT) (the “Confirmation Hearing”) at the Earle Cabell Federal Building, 1100 Commerce St., 14th Floor, Dallas, TX 75242-1496. Creditors and parties-in-interest are welcome to attend.
